VISA ENQUIRY

Good day to you all....i stumbled upon this blog in the most funny circumstances and i have been well informed since reading and going through all the trend. 
I have a situation and i would like your advice on it, my fiance is in the u.s.a and we plan on getting married next year ending. she actually works and studies but at the same time leaves with her dad as of right now, though she intends to move out, we want to file for me on the basis of marriage (she will be coming to Nigeria this year) where we would go for a court wedding. based on this do you think i would be granted a visa.
i actually work right now and i wont say my pay runs into millions but its fair. i also haven't let the shores of this country, then i would also like to have any other opinion that can be helpful. we were also thinking of going for the tourist visa but we just want to weigh our options before heading to the embassy.

If your fiance is a citizen or a permanent resident who has been in the US for at least 6 months, then she could petition for you to come to the US as a K-1 Visa applicant for you to get married there. However, if she is there for a temporary stay, then she is not qualified to petition for you. You may have to apply for a B1/B2 Visa which is a Tourist/Business Visa to visit her. This is subject to denial or approval and that depends solely on the consular officer who interviews you.

    A person who wishes to immigrate to the United States must have a petition approved by the U.S. Citizenship and Immigration Services (USCIS) before applying for an immigrant visa. The petition is filed either by a qualified relative or a potential employer at a USCIS office in the United States. Specific information about filing immigrant petitions is available on the USCIS website. An individual with an approved petition and a priority date that is current for processing (when applicable) is eligible to apply for an immigrant visa or K non-immigrant visa.

  2. Dear friend, as anonymous above responded, it all depends on your fiance's status. If she is a citizen or permanent resident, the possibility of your application getting approved increases as long as you can prove the validity of your marriage. If she is an H1B holder like I am, you can apply for the H4 visa. Only limitation is on this visa, you are not allowed to work. My husband's application was approved yesterday so it is doable. I pray God's favor rest upon you both as you plan your life together.
